The process of handling notarization on behalf of clients in China

1) The client can submit notary inquiries to China Notary Service Center (hereinafter referred to as the Service Center) by WeChat, email or telephone;

2) The Service Centre designs solutions for the client based on the information received;

3) The client agrees to the solutions provided by the Service Center, submits all required documentation for notarization, and enters into a service contract with the Service Center;

4) The Service Centre inspects and sorts out the client’s qualifications for notarization and the content of the materials and documents provided;

5) If it is necessary to draft a notarial document, the Service Centre can draft it for the party concerned (or provide the notarial document by itself, but must ensure the notarization can be handled), and confirm and finalize the notarial document with the docking notary office;

6) The Service Centre shall guide the agent to bring the original documents of notarisation to the designated notary office to handle the notarisation with the notary in charge.

7) Where part of the original documents need to be sent to the notary office by mail, the notary office shall, upon receipt of the mail materials and examination of them, issue a notarial certificate in accordance with the relevant procedures.

8) Upon completion of preparation of the notary deed, the notary will firstly issue a scanned copy to the party concerned for use. The original copy of the notary deed may be obtained by the agent from the notary office or be mailed by the agent (only domestically and the postage shall be borne by the agent himself).

9) The party concerned shall, in accordance with the relevant provisions on the standards for notarization charges, pay the notary service fees and other fees that may be incurred, including the fees for the translation of notarial certificates and documents under application for notarization, the photocopy fees and the mailing fees, etc. Apart from the service fees, the Service Centre shall not charge any other fees for the notarization.

10) After the notarization procedure, the party concerned shall contact the notary organ through the Service Centre to post the notarized documents to the party’s designated domestic receiver, and the postage shall be borne by the party concerned. The relevant fees shall be handled by way of refund for any overpayment or a supplemental payment for any deficiency.
